Gossip Girl’s Kelly Rutherford was granted a temporary restraining order against her ex-husband Daniel Giersch in LA County Superior Court yesterday.
Kelly claimed in court docs that Daniel harassed her and her nanny, so much so that the nanny actually quit.
Daniel is now required to stay 100 yards away from Kelly, her nanny, and her mom, but will somehow still get to keep the legal visitations with his two unfortunate kids.
Kelly Rutherford and her husband Daniel Giersch finally settled the custody battle over their two kids Hermes and Helena in court today.
The Gossip Girl actress first filed for divorce in December of last year, and the couple have been duking it out over everything from potty training to pool safety ever since.
The final custody papers state that Kelly and Daniel will both move from California to NY while Kelly films her show from July through April. They’ll share joint legal and physical custody of both kids, and both parents will be required to attend co-parenting counseling sessions. The custody agreement will be reviewed again in April 2010.
Kelly Rutherford used this week’s issue of Life & Style Magazine to show off her motherly side… and throw another verbal beat-down at her ex-husband Daniel Giersch.
Kelly told the mag that she originally thought that the little creature pictured above would save her marriage, but boy was she wrong:
I found out I was pregnant, and I thought, Oh, maybe things will be nice, maybe it will be calm… But it wasn’t. Things only got more intense.
Daniel apparently threatened to sabotage her career and ruin her life. He even bugged out her friends, to the point where they finally had to combine their powers to help Kelly leave him.
Kelly even told the mag that with a crazy guy like Daniel, her kids are better off without a daddy. According to her,
The most important thing is that the children have love and stability in their lives, whether that comes from a mother or a father. I can raise them to be much more peaceful.
The couple have been battling out custody arrangements for Helena and her 2-year-old brother Hermes in court for the better part of this year.
Even though Daniel Giersch had filed paperwork to legally force his crazy ex-wife Kelly Rutherford to notify him before the birth of his baby daughter, she somehow forgot to do so when she went into labor yesterday.
When the Gossip Girl actress gave birth to the couple’s second child Helena late last night, tabloids were quick to note that Daniel had skipped out on the big moment. A source close to the businessman claims however, that Daniel didn’t personally decide not to go, he was simply just not notified. The source says,
She failed to tell him and instead he found out this morning on the Internet. He was robbed of an opportunity to be at the hospital when his child is born. He is sad and disappointed.
Daniel and Kelly, who have been embroiled in a bitter custody battle over their 2-year-old son Hermes for months, have already begun their war over Helena. According to Daniel,
We are currently negotiating how often I am allowed to go to the hospital. The only thing the judge said in court last time is that I can see my daughter three times a week for one hour.

After several days of legal haggling, the pair finally agreed today to have their kid wear pull-ups, and allow him to make the decision on when to potty train himself.
Kelly is now getting ready for her next court battle over the couple’s new baby, who she’s set to give birth to next month.
Kelly Rutherford, who has been involved in the nastiest of nasty custody battles with her ex Daniel Giersch, has filed papers in court, asking a judge to ban Daniel from bringing their 2-year-old Hermes over to his house.
In the papers, Kelly states that she’s concerned about the improperly secured pool and play areas at the home. She’s also upset over something concerning pee and poop, and has asked the judge to force Daniel to quit potty training the boy.
Kelly and Daniel will be in court to duke it out on Friday. Meanwhile, Daniel has been ordered to cover his pool.

In the mag, Kelly talks about some boring baby stuff, like reminiscing about helping mom out with her baby brother, and how she hopes that her kid will grow up to be smart with good values. Kelly also takes the chance to drop a few lines about just how much Hermes LOVES being on the set of Gossip Girl. Kelly says,
He loves the makeup and hair trailer. He’s always blow-drying everyone’s hair. There’s the little forklift that they use to build the sets—he loves to check that out. And all the trucks and brooms—he loves to sweep. There’s so much that he loves to play with.
Ex husband, Daniel Giersch seems to have a different opinion on how Hermes feels about being on set with mommy, but what do daddies know anyways?
The judge in the Kelly Rutherford/Daniel Giersch custody battle ruled today that Kelly will be allowed to go back and forth from LA to NY with her son, Hermes for the next two months to shoot Gossip Girl. Daniel was arguing that the travel would be detrimental to Hermes’ well-being, but the judge cited the fact that Kelly had a contractual agreement to work in NY.
The judge also gave custody of the kid to Kelly, allowing Daniel only two overnight visits per week for the next month. Daniel will then be able to have Hermes for three nights per week in March. The couple will be back in court over the next two months to come to a long-term agreement.
Kelly Rutherford’s nasty custody battle just got nastier times 100. Her soon-to-be ex, Daniel Giersch has just claimed in court that on top of not encouraging their 2-year-old Hermes to potty train, Kelly doesn’t wipe his butt well enough after he poops. Daniel says,
I have witnessed that she does not always keep his bottom clean.

But what if she disappears with the kid?
Daniel has hit back, claiming that Kelly spends a lot of her time in NY filming her show while he takes care of Hermes. He says when she is around, she’s often getting beauty treatments. Daniel also claims that Kelly once threw a laptop at him when she was angry.
The ex couple, who are expecting their second baby in June, both want sole custody of the kid, and are prepped for battle.
